By accessing or using ProShot ("the Service"), available at proshot.site, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. ProShot reserves the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Account Creation

To use ProShot, you must create an account by signing in with your Google account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must be at least 18 years old to create an account. You agree to provide accurate and complete information and to notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree to use ProShot only for lawful purposes. You must not:

  • Upload images that infringe on third-party intellectual property rights.
  • Use the Service to generate illegal, harmful, misleading, or offensive content.
  • Attempt to reverse-engineer, decompile, or tamper with the Service.
  • Use automated tools to scrape, crawl, or excessively burden the Service.
  • Share your account credentials with others or allow unauthorized access.
  • Use the Service for any fraudulent or deceptive purposes.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

4. Intellectual Property

Your Content: You retain full ownership of the images you upload and the AI-generated images produced by the Service. You grant ProShot a limited, non-exclusive license to process your images solely for the purpose of providing the Service.

Our Content: The ProShot platform, including its design, code, AI models, scene presets, branding, and all related intellectual property, is owned by ProShot and protected by applicable laws. You may not copy, modify, or distribute any part of our platform without written permission.

5. Payment Terms

  • Payments are processed securely through LemonSqueezy. By purchasing a subscription or credits, you agree to LemonSqueezy's terms of service.
  • Subscription plans are billed monthly. Your subscription automatically renews unless cancelled before the end of the billing period.
  • Pay-as-you-go image credits do not expire and are non-transferable.
  • Prices are listed in USD and may be subject to applicable taxes.
  • ProShot reserves the right to change pricing with reasonable notice. Existing subscriptions will be honored until the end of the current billing period.

6. Refund Policy

We offer a 7-day money-back guarantee for new subscriptions. If you are not satisfied with the Service, you may request a full refund within 7 days of your initial purchase. Refunds for pay-as-you-go credits are available only if no credits have been used. To request a refund, contact us at enes@agencylambda.com.

7. Service Availability

We strive to keep ProShot available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, ProShot and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to ProShot in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that AI-generated images will meet your specific requirements or expectations.

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at our discretion if you violate these terms. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes for a limited period after termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
